The Ph.D (Law) programme offers candidates an opportunity to contribute to the academic field in their chosen areas of study. ​As a part of the programme, candidates are also provided an opportunity to teach or participate in ongoing research at NLSIU, in areas related to their dissertation, allowing for deeper integration with the NLSIU community and providing diverse feedback opportunities.

Eligibility for Ph.D. (Law)

The following candidates shall be eligible to apply for the Ph.D. (Law) programme:

a) Candidates having a 5-year/ 10-semester/ 15-trimester bachelor’s degree programme in Law through regular mode from a recognized University having secured a minimum of 75% marks in aggregate or its equivalent grade on a point scale wherever the grading system is followed (70% of marks or its equivalent grade in case of SC/ST/OBC- NCL/Persons with Disability.)

b) Candidates having a 3-year/ 6-semester/ 9-trimester bachelor’s degree programme in Law (LL.B.) through regular mode from a recognized University having secured a minimum of 75% marks in aggregate or its equivalent grade on a point scale wherever the grading system is followed (70% of marks or its equivalent grade in case of SC/ST/OBC-NCL Persons with Disability); and

c) Candidates having a Masters in Law degree (LL.M.) through regular mode from a recognized University having secured an aggregate of at least 55% marks or its equivalent grade (50% of marks or its equivalent grade in case of SC/ST/OBC-NCL)/ Persons with Disability);

d) Candidates having passed the Solicitors Examination conducted by the Bombay Incorporated Law Society and having a completed a bachelor’s in Law (LL.B./LL.B. (Hons.)) degree from a recognized University through regular mode; or

(e) Candidates having a Master of Business Laws (MBL) degree from the National Law School of India University with minimum CGPA (Cumulative Grade Point Average) of 4.00 and having completed a bachelor’s degree from a recognized University through regular mode.

Provided that candidates in their final year of study in the respective degrees in (a), (b) and (c) shall be eligible to apply, subject to the candidate securing the minimum marks or equivalent grade prior to July 2024.

International Students

Candidates can apply for the NLSAT – International Examination for “international student” category, if they fulfil the following conditions:

  • They should be a citizen of a country other than India; AND
  • They should have completed a minimum of ten years of their education in a school/college/university outside India.

Admission Process

Admission to the programme will be through an all-India written admissions test, the National Law School Admissions Test (NLSAT-PhD). Candidates shall submit the application form duly filled up along with a research proposal of about 6-8 pages. The application form is available here.

The research proposal should contain: i. Tentative Title ii. Statement of the problem and the background information on the subject. iii. A brief outline of the research design including a set of research questions, a brief review of the relevant literature on the issue identified for research, a research hypothesis (where applicable) and the proposed methodology. Students who demonstrate a firm grasp of these foundational issues will be awarded higher marks.

The NLSAT-PhD shall have the following scheme: a) Research Aptitude: 50 marks b) Essays/Answers on relevant topics pertaining to law/ other disciplines: 50 marks

Candidates securing not less than 50% marks on the aggregate in the written test will qualify for evaluation of their Research Proposal and making an oral presentation before a Panel of Experts on the date specified by the University.

Selection Process

Candidates will be selected based on the marks obtained by the candidate in the NLSAT- PhD, the research proposal, and the oral presentation. The weightage of each score component shall be as follows:

a) NLSAT-PhD: 50% b) Research Proposal: 35% c) Oral Presentation: 15%

Important Dates

  • The National Law School Admissions Test-PhD (NLSAT-PhD) will be held on March 17, 2024 (Sunday), from 10.00 am to 12.30 pm in specified centres across the country. The duration of the test shall be 150 minutes.
  • Application deadline has been extended to 11:59 pm IST, on February 28, 2024. View official notification. An application fee of Rs. 3000/- (Rupees Three Thousand Only) shall be payable at the time of submission of the application.
  • The dates for the oral presentation shall be announced after the completion of the NLSAT-PhD. They are likely to be held in April – May 2024.
  • Classes for coursework component of the Ph.D. programme shall commence in the University in July 2024.

The maximum number of Ph. D seats for the Academic Year 2024-25 are 8 (Eight). This includes 4 in Ph.D (Law) and 4 in Ph.D (Interdisciplinary). The University reserves the right not to fill all the seats where sufficient candidates do not satisfy the admission requirements.

The total amount payable at the time of admission by foreign students for AY 2024-25 is Rs. 2,55,000/- as provided below:

Sample questions for NLSAT 2024 will be released to candidates who have registered through the admissions portal prior to the admissions test.

The University’s PhD programme in the previous year was offered in terms of the Ph.D. Degree Programme Regulations, 2021. The Regulations have been revised since the Academic Year 2023-24.

NLSIU currently offers two Ph.D programmes:

– The Ph.D. (Law) programme allows a candidate to contribute academically in the field of law; – The Ph.D. (Interdisciplinary) involves research across disciplines to arrive at a more comprehensive perspective and solution for a particular problem.

No, there is no age limit to apply for the programmes.

The University shall conduct a written test (NLSAT-Ph.D) along the following scheme:

a) Research Aptitude – 50 marks b) Essays on relevant topics pertaining to law/ other disciplines – 50 marks 

The list of selected candidates as above shall be displayed on the NLSIU website.

Candidates are required to be present at the NLSIU campus for the duration of their coursework spread over three trimesters. Course work is compulsory for all the Ph.D. candidates.

The first component of the course work must be completed during the first trimester upon their admission. The remaining two trimesters of the course work needs to be completed within the first two academic years.  

a) The candidate will have to complete a minimum of three (3) years’ research in their chosen subject, including the mandatory course work as provided in these Regulations.

b) Maximum period: The maximum duration of the Ph.D. programme shall be six (6) years* from the date of admission in the Ph.D. programme, subject to the fulfilment of the requirements per the Regulations.

*- Provided that candidates who are Persons with Disabilities (having more than 40% disability) may be allowed a relaxation of upto two (2) years; however, the total period for completion of a Ph.D. programme in such cases should not exceed eight (8) years from the date of admission in the Ph.D. programme; – Provided further that female Ph.D. candidates may be provided Maternity Leave/ Child Care Leave for up to 240 days in the entire duration of the Ph.D. programme; however, the total period for completion of a Ph.D. programme in such cases should not exceed six (6) years and eight (8) months from the date of admission in the Ph.D. programme.

c) Failure to complete the course within the maximum period set out in point (b) above will automatically result in cancellation of registration.

There are a total of six courses that a doctoral candidate has to complete. Three of these are compulsory taught courses. Each taught course will extend for around 10 weeks and will be held on campus.

The first compulsory taught course is to be completed in the initial trimester on admission to the programme. The second compulsory taught course can be completed in the initial or any subsequent trimester (depending on when the course is offered). These two taught courses have to be completed prior to the first presentation before the Research Advisory Committee. In addition, there are also two course requirements relating to review of literature and fine-tuning of the proposal which need to be completed under the guidance of the Supervisor prior to the first presentation before the Research Advisory Committee.

The third compulsory taught course has to be completed prior to the second presentation before the Research Advisory Committee. In addition, candidates also will also need to complete the course requirement relating to teaching/research assistantships as will be decided by the Supervisor/relevant University body of the University.

There is a Research Advisory Committee for each Ph.D. scholar consisting of a Supervisor and two members (one from within NLSIU and one external member).

We do not offer rolling admissions to the PhD programme. New students are admitted once a year, to begin studying at the start of the Academic Year in July.

Yes, but only in the next academic year. Candidates will have to appear for the NLSAT after applying for the programme in any given year.

Ph.D. Program in Law has commenced at HNLU w.e.f. academic session 2014-15 wherein admission of scholars is made strictly on the basis of admission test conducted by the University separately. 

HNLU invites applications for Admissions into the Doctorate in Philosophy (Ph.D.) Programme in Law and Inter-disciplinary studies. The doctoral program at HNLU seeks to provide a forum to the students from legal and inter- disciplinary fields to pursue their academic interests and contribute towards their chosen area of study.

  • *As per the circular issued by the Government of Chhattisgarh No. एफ / 13-3/2023 / आ.प्र. / 1-3, dated 09/05/2023, the reservation of seats for the ST/SC/OBC will be applicable as per the prevailing reservation rule at the time of admission.
  • 5% seats shall be reserved horizontally for Specially Abled Persons (SAP) at the All- India and Chhattisgarh levels according to The Rights of Persons with Disabilities Act, 2016.
  • 3% seats shall be reserved horizontally for the Dependents of Freedom Fighters (DFF) category of candidates belonging to the State of Chhattisgarh
  • If a Chhattisgarh domicile candidate qualifies for admission in the regular merit under the All-India category, the candidate shall be considered against the All-India seat only and not against Chhattisgarh domicile
  • 30% of seats shall be reserved horizontally for female candidates across all categories of seats.
  • The allotment of seats to various CG Domicile category candidates will be made as per the Guidelines issued by the Government of Chhattisgarh from time to time.
  • Students who are transferred from other Universities as per the HNLU Ph.D. Ordinance will be considered as admission to Supernumerary Seats.

Eligibility

  • Candidates with a Master’s Degree or a professional degree declared equivalent to the Master’s Degree by the corresponding statutory regulatory body, with at least 55% marks in aggregate or its equivalent grade ‘B’ in the UGC 7-point scale (or an equivalent grade in a point scale wherever grading system is followed) or an equivalent degree from a foreign educational institution accredited by an Assessment and Accreditation Agency which is approved, recognized or authorized by an authority, established or incorporated under a law in its home country or any other statutory authority in that country for the purpose of assessing, accrediting or assuring quality and standards of educational institutions. Candidates with LL.M or equivalent degrees are eligible to apply for PhD in Law or interdisciplinary Ph.D. However, candidates with other Masters degrees or professional degrees are eligible to apply only for interdisciplinary Ph.D.
  • A relaxation of 5% of marks, from 55% to 50%, or an equivalent relaxation of grade, shall be allowed for those belonging to SC/ST/OBC(non-creamy layer)/differently-abled and other categories of candidates as per the decision of the University Grants Commission from time to time.
  • Candidates who have appeared in the qualifying examination but awaiting results are also eligible to apply, provided that the result of the qualifying examination shall be submitted by the candidate at the time of registration, failing which their candidature shall be canceled.

Program Duration: Ph.D. program shall be for a minimum duration of three years from the date of registration and a maximum of six years.

Admission Process

Stage I: Entrance Test (100 Marks)

  • Candidates have to appear for an All-India Ph.D. Entrance Test which shall be for a duration of 2.5 hours.
  • Component 01 – Research Aptitude Test – 50 Marks [Syllabus] – Common to all candidates
  • Component 02 – Legal Test (for Ph.D. in Law – [Syllabus] ) or Allied Discipline Test (for Ph.D. in Law & Inter-disciplinary Studies – [Syllabus] )– 50 Marks

The candidate needs to score a minimum of 50 % of marks in each component to qualify in the Ph.D. Entrance Test

Candidates, who have qualified for UGC NET (Junior Research Fellowship (JRF)/ lectureship) or SLET, shall be exempted from the Entrance Test. 

Stage II: Personal Interview

  • Shortlisted candidates including UGC NET (Junior Research Fellowship (JRF)/ lectureship) or SLET qualified candidates will be required to discuss their research interest/area through a presentation followed by an Interview before the Committee.
  • The competence of the candidate for conducting the proposed research,
  • The feasibility/suitability of conducting the proposed research work at the University,
  • The contribution of the proposed area of research towards knowledge creation / up– gradation.
  • Credit Requirement: After having been admitted, each D. scholar shall be required to undertake Course Work. The credit assigned to the Ph.D. course work shall be 14 credits for students registered for Ph.D. in law and 16 credits for students registered for interdisciplinary Ph.D.

  • Supervisor : A Ph.D. student shall undertake research work under the guidance of a supervisor allotted by the RDCU. Allotment of Supervisor shall be based on the availability of seats, the specialization of the faculty, the research interest of the candidates

    4.   Attendance:

  •   Ph.D. scholars shall be required to be present in the University as per the notification issued in this regard.
  • For candidates drawing scholarship/fellowship/stipend or any other monetary benefit from this University or any other organization, attendance is mandatory throughout their registration period and may be allowed to leave the University upon sanctioned leaves, fieldwork, Conferences/seminars etc.

    5.  Progress Review

  • Candidates selected for the Ph.D. Programme shall submit a Progress Report to the Supervisor and Co-Supervisor in every six months and a mandatory presentation of the progress shall be made before a panel as decided by the RDCU and the Supervisor/Co-
  • The Second or third half-yearly report shall indicate the specific topic of research, along with the final Synopsis in the prescribed format based on the literature survey relevant to the research. The final Synopsis shall be presented before the RDCU for feedback and comments, which shall be suitably incorporated into the Synopsis under the advice of the Supervisor

PH.D Programme

  • The candidate shall have LL.M degree or any Masters degree having the potentiality of interdisciplinary study with law from any university recognized by UGC or equivalent LL.M or Masters Degree of foreign university with a minimum of 55% marks or equivalent CGPA.
  • However, this condition is relaxed to 50% in case of candidates belonging for those who obtained their masters degree prior to 10th September 1991
  • The condition is relaxed to 50% in case of candidates belonging to SC and ST/OBC (Non creamy layer) or differently abled categories.
  • Candidates who have qualified for UGC/SLET/SET/JRF fellowships or having M.Phil. Degrees are exempted from Entrance Test. However, they have to undergo an interview.
  • Admission of candidates under 1.1 above to Ph.D/M. Phil shall be through an Entrance test and interview.
  • Admission of candidates under 4 above shall be on the basis of interview. SHORTLISTING OF CANDIDATES: All the applicants have to submit a Research Proposal within 3000(three thousand ) words. The Proposal shall content- Title; Statement of problem, Literature Review, Prior Research; Objectives of Study; Research Questions; Hypotheses; Methodology including sample framework, units of data, Primary and secondary sources and statistical analysis (if required)probable contribution of the study and limitation of the study. On evaluation of the Research Proposals the short listed candidates are called for written tests and/or Interview as the case may be.

The Entrance Test shall consist of one paper of 100 marks with 3 hours duration. The syllabus of the paper shall cover:

  • B. Written Exam The syllabus of the LAW paper shall cover 50 marks questions on Research Methodology and other 50 marks should be from various law subjects or interdisciplinary subjects as the case may be. Law subjects are- Law of Contract; Constitutional Law; Law of Crimes; Public International Law; Jurisprudence; Company Law; Intellectual Property Law; Information Technology Law; Interview for all qualified candidates – 50 marks

Selection of candidates for the available seats shall be on the basis of marks obtained in Research Proposal, entrance test plus interview or Research Proposal and interview only as the case may be on the basis of merit. Date of the interview will be notified later on.

Eligibility Criteria

  • LLM with at least 55% marks or an equivalent grade. Professional qualification such as CA/ ICWA/ CFA/ CS (both 5 year integrated or 3 years after graduation) with minimum 55% marks.
  • Master’s degree in a discipline relevant to the proposed research with at least 55% marks or equivalent grade.
  • Applicants with more than 3 years industry/ teaching/ practicing/ managerial/ professional experience will be given preference.
  • Relaxation of 5% of marks, from 55% to 50%, or an equivalent relaxation of grade, may be allowed for those belonging to SC/ST/Differently-Abled categories or for those who had obtained their Master’s degree prior to 19th September, 1991. The eligibility marks of 55% (or an equivalent grade in a point scale wherever grading system is followed) and the relaxation of 5% to the categories mentioned above are permissible based only on the qualifying marks without including the grace mark procedures.

Categories of Admission

Applicants shall be admitted to the Ph.D. Programme under one of the following categories:

  • Full-time Ph.D. Student (with or without fellowship) “means a person enrolled in the Ph.D. Programme devoting full-time to completing the requirements of the degree.”
  • Part-Time Ph.D. Student (without fellowship) “means a person who is registered in the Ph.D. Programme devoting part of his/ her time for completing the requirements of the degree while discharging other employment obligations.”

The Ph.D. in Law prepares graduates for global leadership in the judiciary, academia, business and government. Since 1966, the program has offered a select number of diverse students the opportunity to attain their highest professional aspirations and career goals. A preeminent center for interdisciplinary legal studies, UW Law offers a global focus and innovative approach to integrating legal scholarship within the humanities and social sciences, medicine and global health, business and technology, and environmental and public policy.

The Ph.D. program is designed to provide a rich and thorough foundation in research methodologies, jurisprudence, legal theory, policy, dissertation preparation and ready access to specialized elective coursework from within the law school and university-wide research centers, institutes and schools. Throughout the program, our graduate students receive individualized attention from exceptional faculty and staff.

With its long and respected history, the Ph.D. program provides students with a global alumni network. Alumni are committed supporters and mentors and lead in many sectors around the world.

The Ph.D. program requires a minimum of three years’ study, at least two years of which are comprised of coursework taken while in residence at the UW. Ph.D. candidates must complete 90 credits. A minimum of 60 credits must be taken at the UW including a minimum of 27 dissertation credits. Some of the credits earned in an LL.M. program may be counted among the 60 credits.

Doctoral dissertation committees are led by faculty experts from UW Law and include members with deep knowledge and expertise from across the university. Students can customize their studies with interdisciplinary coursework, independent study, field research, global internships and externships.

Eligibility for Admission

National Law University Delhi offers the following Ph.D. Programmes:

  • Ph.D. Degree in Law

Ph.D. Degree in Social Sciences viz., Political Science, Sociology, Criminology, Economics, and English

Ph.d. degree in law : eligibility for admission for ph.d. in law for indian nationals.

  • A Master's degree in Law or a professional degree declared equivalent to the Master’s degree in Law by the corresponding statutory regulatory body, with at least 55% marks in aggregate or its equivalent grade 'B' in the UGC 7-point scale (or an equivalent grade in a point scale wherever grading system is followed) or an equivalent degree from a foreign educational institution accredited by an Assessment and Accreditation Agency which is approved, recognized or authorized by an authority, established or incorporated under a law in its home country or any other statutory authority in that country for the purpose of assessing, accrediting, or assuring quality and standards of educational institutions.
  • Obtained a degree in law and Master’s Degree in social sciences or humanities from any recognised educational institution, Indian or a foreign educational institution accredited as per UGC Regulations, with at least 55% marks in aggregate or its equivalent grade 'B' in the UGC 7-point scale (or an equivalent grade in a point scale wherever grading system is followed). Provided that candidates with qualifications in social sciences and humanities may be admitted to the programme if the research they wish to pursue interfaces with the discipline of law with a special focus on Public Policy or Law. For the above two categories, a relaxation of 5% of marks, from 55% to 50%, or an equivalent relaxation of grade, may be allowed for those belonging to SC/ST/OBC (non-creamy layer)/ Differently-Abled/ Economically Weaker Section) candidates and other categories of candidates, as per the decisions of the UGC from time to time, or for those who had obtained their Master's degree prior to 19th September, 1991. The eligibility marks of 55% (or an equivalent grade in a point scale wherever grading system is followed) and the relaxation of 5% to the categories mentioned above are permissible based only on the qualifying marks without including the grace mark procedures.
  • Degree in law and passed the Company Secretary examination conducted by the Institute of Company Secretaries of India and awarded the Associate Membership of the Institute shall be eligible for admission to the programme, if the research they wish to pursue interfaces with the discipline of law.
  • Degree in law and passed the final examination of the Institute of Chartered Accountants of India shall be eligible for admission to the programme, if the research they wish to pursue interfaces with the discipline of law.
  • Judge of any State High Court in India with three years’ experience or Judge of Supreme Court of India.
  • Obtained a Bachelor’s Degree and Master’s Degree in relevant Social Sciences or humanities from any recognised educational institution, Indian or a foreign educational institution accredited as per UGC Regulations, with at least 55% marks in aggregate or its equivalent grade 'B' in the UGC 7-point scale (or an equivalent grade in a point scale wherever grading system is followed). A relaxation of 5% of marks, from 55% to50%, or an equivalent relaxation of grade, may be allowed for those belonging to SC/ST/OBC (non-creamy layer)/ Differently-Abled/Economically Weaker Section) candidates and other categories of candidates, as per the decisions of the UGC from time to time, or for those who had obtained their Master's degree prior to 19th September, 1991. The Vice Chancellor may also permit a NLUD faculty member to enroll for the Ph.D. programme along with the teaching assignment of the concerned faculty member in the interest of faculty improvement on the condition that teaching and other responsibilities of the faculty member are not hampered in any way provided such candidates fulfill the conditions prescribed in the Ph.D. Regulations.

Eligiblity criteria for admission of Foreign Nationals

  • Admission through Study in India : A foreign national may apply for enrolment in Ph.D. programme through Study in India Programme of Ministry of External Affairs, Government of India. The candidates shall have sufficient proficiency in English language. Foreign nationals are exempted from the entrance examination conducted by NLUD for Ph.D. enrolment. All other requirements for admission which are applicable to Indian nationals shall be applicable to foreign nationals also. The number of seats available for foreign nationals will be decided by the university on year-to-year basis. In the event of non-availability of suitable candidates, NLUD reserves the right not to fill up the seats and if required, these seats shall be converted to any other categories of Ph.D. admission for foreign nationals. Candidate will be required to pay the fees applicable to foreign nationals under R. 4A.
  • Admission through ICCR : A foreign national may apply for enrolment in Ph.D. programme through ICCR Programme of Ministry of External Affairs, Government of India. The candidates shall have sufficient proficiency in English language. Foreign nationals are exempted from the entrance examination conducted by NLUD for Ph.D. enrolment. All other requirements for admission which are applicable to Indian nationals shall be applicable to foreign nationals also. The number of seats available for foreign nationals will be decided by the university on year-to-year basis and will be within the seats fixed by the university for ICCR. In the event of non-availability of suitable candidates, NLUD reserves the right not to fill up the seats and if required, these seats may be converted to any other categories of Ph.D. admission for foreign nationals. Fee applicable to candidates under this category will be at par with Indian Ph.D. scholars. For the purpose of this regulation, a foreign national shall mean a candidate who possesses citizenship of a country other than India and holds a valid passport.
  • For admissions under Study in India and ICCR category, the Vice- Chancellor reserves the right to provide extended time period for completing the admission procedure. Extension up to 2 years may be provided by the Vice- Chancellor on case-to-case basis.
  • A foreign national, who is interested in enrolling for the Ph.D. programme at NLU Delhi, and is currently enrolled for Ph.D. programme at a foreign university/institution having MoU with NLU Delhi, may be allowed to be registered for Ph.D. programme at NLU Delhi subject to the condition that one supervisor will be from NLU Delhi and one from the parent foreign university/institution of the candidate. Such a candidate will be exempted from appearing in the entrance test, subject to the condition that the candidate fulfils the other minimum eligibility conditions.
  • The Vice-Chancellor will be the competent authority to allow registration of such candidates on case-to-case basis, on the recommendations of the Doctoral Committee.
  • The candidate will be required to visit NLU Delhi for Viva-Voce to defend the thesis as per NLU Delhi Ph.D. Regulations.
  • The fee for the programme shall be in accordance with the terms and conditions of the MoU between NLU Delhi and the concerned foreign university/ institute.
  • No separate Ph.D. degree of NLU Delhi will be awarded in such cases. A joint degree may be awarded, if required under the MOU.

For the purpose of this regulation, a foreign national shall mean a candidate who possess citizenship of a country other than India and holds a valid passport of Foreign Country.

The 2024 PhD admissions to government universities like DU, BHU, BBAU, and JNU will be based on the NTA PhD entrance test. The last date for submission of PhD admission form is 15 July 2024, through the official website of the selected university.

To apply for a PhD, you have to complete a 10+2, Master's, and Master's degrees with 45% to 60% marks. PhD course fees range from Rs 80,000 to Rs 1,20,000.

Law school welcomes new faculty.

The Law School recently welcomed two new members to its academic faculty, Vincent Buccola, ’08, and Darrell A.H. Miller, whose appointments were effective July 1. In addition, William A. Birdthistle joined the faculty last April as a Professor from Practice. The three new faculty members bring a wealth of knowledge and experience in areas that include corporate law, constitutional law, civil rights law, business restructuring, and financial regulation.

Buccola, who most recently was Associate Professor of Legal Studies & Business Ethics at The Wharton School of the University of Pennsylvania, is a graduate of the Law School and a former Bigelow Fellow.

Miller joins the Law School from Duke Law, where taught for 11 years. Birdthistle recently served at the Securities and Exchange Commission and previously a faculty member of Chicago-Kent.

“These are three outstanding additions to our faculty,” said Thomas J. Miles, Dean, Clifton R. Musser Professor of Law and Economics. “They expand the scholarly insight and professional perspective in important fields of law in our intellectual life, and our students will benefit from these new colleagues’ splendid teaching.”

Buccola’s scholarship focuses on corporate financial and managerial law, especially as it pertains to reorganization, distress, bankruptcy, and leveraged finance. After clerking for Judge Frank H. Easterbrook of the US Court of Appeals for the Seventh Circuit and serving as a trial lawyer at Bartlit Beck, Buccola served for two years as a Bigelow Fellow to explore the possibility of an academic career.

“My time as a Bigelow was very formative and a great way to start, although it was quite startling at first to start calling all my former professors by their first names,” he said.

After the Fellowship, Buccola taught at The Wharton School, where he received several teaching and scholarship awards. In the fall of 2023, he taught business organizations at the Law School as a visiting professor.

“What I love about teaching is that the students provide an endless supply of enthusiasm for new discovery, something that’s harder to find as you get older,” Buccola said. “Witnessing students have those moments is gratifying but also inspiring to me as a researcher, who is always looking for those moments.”

Buccola has a keen interest in the relationship between the financing and management of organizations, and how each one informs the other. “There is an inevitable tension between people who put up money for some kind of project or enterprise—and people who manage that capital to run the project or enterprise,” he said. “How investors and managers of capital negotiate those two ideas is at the core of a lot of the work that I do.”

One of Buccola’s current research projects explores the terms that go into loan contracts and how those terms are selected. His goal is to understand how lenders and borrowers create terms that show up in real contracts.

Another working paper, which he is coauthoring with Greg Nini of Drexel University’s LeBow College of Business, concerns how loan contract terms changed after surprising and aggressive forms of restructuring transactions had taken place.

In their paper, Buccola and his coauthor found that the terms in contracts actually changed quite rapidly, at least in one of the instances, contrary to what many people in industry were saying. “I think we were able to prove that the loan market is much more capable of adjusting, more so than what the skeptics had realized,” he said. That paper, “The Loan Market Response to Dropdown and Uptier Transactions,” is forthcoming in the Law School’s Journal of Legal Studies .

Darrell A. H. Miller

Miller served as the Melvin G. Shimm Professor of Law at Duke Law from 2013 to 2024. He is a distinguished scholar of civil rights, constitutional law, civil procedure, state and local government law, and legal history.

Miller's work on the Second and Thirteenth Amendments has been published in leading law reviews, including the Yale Law Journal , the University of Chicago Law Review , and the Columbia Law Review . His Second Amendment scholarship has garnered significant recognition, being cited by the US Supreme Court, US Courts of Appeals, US District Courts, as well as in congressional testimony and legal briefs. He is the coauthor of The Positive Second Amendment: Rights, Regulation, and the Future of Heller (Cambridge University Press, 2018), the first Second Amendment theory book to be written in the wake of the Supreme Court’s watershed decision in District of Columbia v. Heller (2008) and he is currently coauthoring a textbook on the Second Amendment to be published by Foundation Press. 

"What keeps me writing on the Second Amendment is that it’s one of the few areas of constitutional law that’s really brand new, where every Supreme Court decision is potentially ground-breaking,” Miller said. “Second Amendment doctrine is being constructed from the ground up, in real time, in our generation."

Miller also cofounded Duke’s Center for Firearms Law, an academic center dedicated to producing reliable and non-partisan information about the Second Amendment and firearms law for various audiences, and to establishing firearms law as an intellectually rigorous and respected area of scholarly research. 

Discussing his other scholarly work, Miller observed, “My Thirteenth Amendment scholarship has been about unpacking what the word ‘slavery’ means in the Constitution. The Thirteenth Amendment is remarkable because it’s the first—and the only time—the word slavery appears in the United States Constitution. And it appears there only to say that it shall not exist. … My future work on the Thirteenth Amendment is about using the tools of institutional analysis to understand better what antebellum Americans themselves described as the ‘peculiar institution.’”

Miller's academic career began at the University of Cincinnati College of Law, where he was honored twice with the Goldman Award for Excellence in Teaching. Before entering academia, he practiced complex and appellate litigation in Columbus, Ohio, and clerked for the Honorable R. Guy Cole, Jr. of the United States Court of Appeals for the Sixth Circuit.

A cum laude graduate of Harvard Law School, where he served as an editor of the Harvard Law Review , Miller also holds degrees from Oxford University, where he studied as a Marshall Scholar, and from Anderson University.

Birdthistle is an expert in investment funds, financial regulation, and corporate governance, with a special interest in securities law. He recently served as Director of the Division of Investment Management at the US Securities and Exchange Commission (SEC), where he worked from 2021 to 2024.

That role, Birdthistle says, was “the best job he ever had” because of how closely it aligned with the kind of scholarship he’d been doing as a professor at Chicago-Kent College of Law for the 15 years prior. It was a role that also made him much more interested in government lawyering.

“I think a revolving door between academia and the government is probably a healthy thing,” he said. “A lot of my colleagues here do or have done similar things: Jennifer Nou in the Office of Information and Regulatory Affairs and Eric Posner with the Department of Justice , for example. Now that I’m back here, I find it invigorating to be around extremely smart people who have served the country and are dedicated to thinking deeply and richly about problems.”

The SEC’s Division of Investment Management regulates around $130 trillion dollars and administers two securities acts that oversee funds and advisors. “We adopted approximately a dozen rules and proposed about fifteen, which is ambitious in just two and a half years,” said Birdthistle.

Birdthistle pours his governmental work experience into the classroom, incorporating real issues that regulators are grappling with right now into his investment funds course, issues such as artificial intelligence and cyber breaches and the rulemaking that’s happening in those areas.

“Understanding how money works is understanding how society works,” said Birdthistle. “By the time you’re done with a class on securities regulation or investment funds or business organizations, you’ll probably have a greater appreciation for how these institutions deal with things that you care about.”

Birdthistle himself is a student at the University. He is candidate for a Ph.D. in history with a focus on economic history and financial regulation in the late 20 th century.

Birdthistle received his MA in history from UChicago and his JD from Harvard Law School, where he served as managing editor of the  Harvard Law Review . Before his SEC work and his tenure at Chicago-Kent, he clerked for the Honorable Diarmuid O'Scannlain on the US Court of Appeals for the Ninth Circuit and practiced law at Ropes & Gray in Boston for five years as an attorney in the firm’s investment management practice.
